Terms of Service — Viral Video Tool

1. Who provides the service

Viral Video Tool is a sole-proprietor business operating in the United States ("we", "us"). These terms apply to viralvideotool.com, your account and our AI video tools. Contact the operator for support, billing, privacy or security matters at [email protected].

You must be at least 18 to create an account or make a purchase. By using the service, you agree to these terms and acknowledge our Privacy Policy. If acting for an organization, you must have authority to bind it.

2. What you receive

We provide an online digital service that transforms permitted photos into AI-generated video scenes, with optional audio processing. There are no physical goods. A credit purchase is delivered by adding credits to your account after the payment provider confirms payment; a generation is delivered separately through My creations when processing succeeds.

Only templates marked as available for generation accept paid tasks. Testing or paused templates may offer local photo or audio previews without accepting a generation. Buying credits does not unlock an unavailable template or guarantee a release date. Check availability before purchasing.

Generation uses third-party AI infrastructure, including Fal when selected for a template. Provider outages, moderation and processing queues may affect availability. Outputs can contain visual errors, altered likenesses or unexpected motion; uploaded audio is normally mixed after generation and does not direct choreography. We do not promise exact identity reproduction, musical synchronization, audience reach or commercial success.

3. Accounts and security

Provide accurate account and billing details, keep your login credentials private and notify support of suspected unauthorized access. You are responsible for actions you authorize through your account. We may investigate suspicious activity and restrict access when reasonably necessary for security, rights protection or legal compliance.

4. Credit packs and payment authorization

Our current products are one-time USD credit packs, listed on the pricing page. We do not currently offer automatic renewal, subscriptions or automatic top-ups for these packs. Each purchase requires a separate checkout authorization for the amount displayed there. Any applicable taxes and the final total must be shown before you pay. Future price changes do not retroactively change completed purchases.

Waffo Pancake is our designated checkout and payment provider when available. Availability depends on merchant approval and payment configuration. Payment-card details are entered on the provider's checkout; we do not store full card numbers or card security codes. Keep your receipt and order number, and check the merchant information shown at checkout and on your statement.

A redirect back to this website is not proof that payment succeeded. Credits are granted after server-side payment confirmation. Contact support if a confirmed payment has not appeared in your account.

5. Spending credits and expiry

Each available template displays its credit cost before you submit. Every independently accepted generation is a separate charged task. After a connection error, check My creations before submitting again to avoid creating a second task.

The currently offered purchased packs have no scheduled expiry while the account remains open. Any expiry for a separately described promotional grant is shown with that grant. Credits are service units, cannot be transferred or resold, and cannot be redeemed for cash except through an eligible purchase refund or where law requires.

If a task cannot deliver a playable result, its credit consumption is reversed after failure is confirmed. Uncertain provider submissions require review first. A reversal restores the original grants and their original expiry; an already expired promotional grant may not increase your available balance. This is different from a refund to your payment method.

6. Refunds and billing problems

You may request a full refund of a credit-pack purchase within 7 calendar days of payment if none of that pack's credits have been used. Confirmed duplicate charges and incorrect charges are also eligible for correction or refund. Used packs are generally not refundable solely because of a change of mind or dissatisfaction with a successfully delivered result. Mandatory consumer rights remain unaffected; beginning use does not automatically waive a right that applicable law preserves.

Send your account email, order number and reason to [email protected] or open a support ticket. Do not send card numbers, passwords or private media links. We aim to acknowledge billing requests within 2 business days and communicate a decision within 5 business days after receiving the information needed for review. Approved refunds are returned through the original payment method; the provider or bank controls the final posting time.

Our Refund Policy explains the process. You may contact us to resolve a billing error before raising a payment dispute, but this does not restrict your right to contact your bank, payment provider or a regulator.

7. Your content and permitted use

You retain rights you already hold in uploaded photos, audio and other inputs. You authorize us and the necessary service providers to process, transmit and store those inputs only as needed to deliver, secure and support the requested service. We do not use your inputs to train our own AI models. Third-party processing is described in the Privacy Policy.

As between you and us, you may use delivered outputs for lawful personal or commercial purposes, subject to rights in your inputs, any applicable third-party model terms and applicable law. We do not claim ownership of your inputs or outputs. AI output may not qualify for copyright protection or be unique; we cannot grant rights in music, a person's likeness, trademarks or other third-party material you do not own.

Upload only material you own or have permission to use, including consent from identifiable people and required permission for any child depicted. A template title or reference video does not license its original soundtrack, performance or footage. Results remain private by default; we do not automatically publish them to social platforms.

8. Prohibited conduct

Do not use the service to create or distribute illegal content, fraud, harassment, unlawful discrimination, non-consensual intimate imagery, sexualized content involving minors, or deceptive impersonation of a real person. Do not misrepresent synthetic media as an authentic recording when this could mislead or harm others. Apply disclosures required by the platform or law where you publish.

Do not infringe privacy, publicity or intellectual-property rights; upload stolen credentials or sensitive information unnecessary for generation; distribute malware; bypass access controls or moderation; scrape private data or systematically extract outputs to build a competing model; or resell account access without permission. Report suspected infringement through our copyright reporting page or support email.

9. Privacy and service records

The Privacy Policy describes information collected, provider disclosures, retention and requests for access or deletion. Download results you wish to keep before their availability ends. Account closure does not require us to erase transaction or dispute evidence that must lawfully be retained.

10. Suspension, closure and unused value

You may request account closure through support. We may suspend or close access for a serious breach, suspected fraud or a legal requirement, with an explanation where lawful and practicable. If we permanently discontinue the service or terminate an account for reasons unrelated to your breach, we will refund the unused prepaid value attributable to purchased credits. Contact support to resolve unused purchased value before voluntary closure; closure does not create a new expiry or remove a statutory refund entitlement.

11. Responsibility and limitations

The service is provided as available. Review each output before publishing or relying on it. It is not professional legal, medical or financial advice. To the extent permitted by law, we are not responsible for indirect or consequential losses, and our aggregate liability for a claim is limited to the amount you paid us in the preceding 12 months. These limits do not exclude liability or consumer remedies that cannot lawfully be excluded.

12. Applicable law, changes and contact

Applicable United States law governs these terms, subject to any mandatory protections available where you live. No exclusive court, mandatory arbitration or waiver of statutory rights is imposed by this clause. Contact support first if you wish to seek an informal resolution.

We will announce material changes through the website or your account email at least 14 days before they take effect, unless an urgent legal or security change requires earlier action. Changes do not retroactively remove rights attached to a completed purchase. If a provision is unenforceable, the remaining terms continue to apply.
